Two years ago: “We should probably start working on AI governance.”
2026: “We must demonstrate AI governance is operational or face regulatory, competitive, and commercial consequences.”
The question isn’t whether to govern AI. It’s whether you’ll be ready when governance becomes enforceable.
Three Forces Converging in 2026
Force 1: Regulatory Convergence
United States: Colorado SB 24-205 takes effect June 30, 2026, the first comprehensive state-level AI regulation requiring developers and deployers of high-risk AI systems to use reasonable care to protect against algorithmic discrimination. The Texas Responsible AI Governance Act is already in force. The federal sector NIST AI Risk Management Framework becomes a procurement requirement.
European Union: Enforcement of the EU AI Act intensifies through 2026. High-risk AI systems face increasing requirements. Fines reach €35M or 7% of global turnover for severe violations. The UK develops its regulatory response whilst the FCA and PRA issue AI governance expectations for financial services firms.
The convergence: Whilst specific laws vary by jurisdiction, core themes remain consistent globally – transparency in AI decision-making, human oversight for high-stakes decisions, security of AI systems and training data, bias mitigation through testing and remediation, clear accountability with escalation paths, and documented evidence of governance (not just policies).
Organisations face mounting pressure to prove AI systems are compliant, transparent, and ethical. Documentation, risk classification, third-party due diligence, and model lifecycle controls shift from best practices to baseline requirements.

Force 2: Competitive Pressure
Sedgwick's 2026 Forecasting Report – drawing on a dedicated survey of 300 senior Fortune 500 leaders spanning C-suite (CEO, COO, CFO, CHRO, CRO) through to EVP, SVP, VP and director level, published December 2025 – shows 67% report progress on AI infrastructure. Momentum is undeniable.
The ready 14% aren’t waiting for regulatory certainty. They’re deploying AI confidently because governance infrastructure enables both speed and safety. These organisations recognise governance as a competitive advantage, not a compliance burden. They entered the governance-growth flywheel early, gaining compounding advantages whilst others debate readiness.
First-mover advantage in governed AI spans stakeholders. Customers prefer organisations with strong governance. Investors seek lower regulatory risk. Partners favour responsible AI users. Employees select ethical companies. Rajjie Sarmey, Wharton-trained global technology executive and former CIO/CTO across the Federal Reserve, Zions Bancorp and PNC Bank, frames the emerging distinction: “Enterprises are separating into AI-Trusted and AI-Opaque categories.
By 2026, boards will demand governance answers, not just deployment updates.”
The competitive separation accelerates in 2026. AI-Trusted organisations scale confidently with stakeholder support. AI-Opaque organisations face increasing scrutiny, resistance, and penalties. The gap between prepared and unprepared organisations widens daily.
Force 3: Stakeholder Expectations
Stakeholders no longer accept “trust us” as governance evidence.
Customers demand explainability. They want to understand how AI systems make decisions affecting them. Algorithmic black boxes erode trust. Transparent, monitored, explainable AI builds confidence and loyalty.
Employees voice concerns. They question the impact on jobs, bias in hiring and performance systems, and ethical deployment. Organisations demonstrating responsible AI governance attract and retain talent. Those without lose people to competitors with stronger ethical frameworks.
Investors focus on AI risk management. They recognise that ungoverned AI creates regulatory exposure, reputational risk, and operational vulnerability. Investment flows toward organisations demonstrating governance capability. Capital becomes harder for those without it.
Regulators demand evidence. As enforcement intensifies, documentation matters. Boards must demonstrate governance infrastructure works: comprehensive AI inventories, risk classifications, monitoring systems, escalation protocols, and measurable outcomes.
Stakeholder expectations converged around a single question: “Show us your AI governance works.” Structures and policies no longer suffice. Operational evidence becomes essential.
Seven Articles, One Message
Article 1: 70% have governance structures, but only 14% achieve readiness. The gap is operationalisation – boards must move beyond policies to proven capability.
Article 2: Invisible AI creates governance gaps larger than boards recognise. Comprehensive discovery reveals the true scope. Visibility forms the foundation for all governance.

The pattern across this series: Governance readiness, not governance structures, determines capability. Sedgwick's 2026 Forecasting Report found that while 70% of Fortune 500 leaders report having AI governance structures in place, only 14% say they are fully ready for AI deployment – a gap that reveals the difference between policy on paper and governance that actually works. The 2026 Readiness Checklist
Seven elements separate prepared organisations from those scrambling:
Comprehensive AI Inventory: Continuous discovery of all AI systems: vendor tools, internally developed applications, embedded algorithms in purchased software. Updated quarterly, not annually. Boards cannot govern what remains invisible.
Board-Level Accountability: Clear ownership at board and executive levels. Cross-functional governance committees with operational authority, not advisory status. Escalation pathways that work when problems emerge.
Governance Infrastructure: Not just policies but operational capability: scaling rules enabling pilot progression, risk-tiered guardrails enabling experimentation, monitoring systems tracking deployed AI, evidence frameworks demonstrating outcomes.
Documented Evidence: Audit trails showing governance in action. Risk classifications with clear criteria. Bias testing protocols and results. Performance monitoring demonstrating reliable outcomes. Documentation proving governance works.
Workforce Preparedness: People trained to use AI responsibly. Teams understanding guardrails and escalation protocols. Governance professionals equipped to steward AI systems. Culture valuing responsible deployment.
Vendor Governance: Third-party AI systems managed as rigorously as internal development. Contractual requirements for transparency, monitoring access, and performance standards. Due diligence processes identifying vendor AI risks.
Stakeholder Communication: Transparent disclosure about AI use in consequential decisions. Mechanisms for stakeholder feedback. Processes addressing concerns raised. Trust built through openness, not opacity.
Organisations implementing these seven elements before 2026 are prepared for regulatory enforcement. Those without face rushed implementation under pressure.
The Window Is Closing
